The Electronic Transactions Act (ETA) is underpinned by the principle of non-discrimination (i.e. an electronic document should not be denied legal effect, validity or enforceability solely on the grounds that it is in electronic form). The ETA, inter alia, (i) creates a predictable legal environment for e-commerce, such as addressing concerns for authentication and non-repudiation of electronic records; (ii) enhances the security of electronic transactions, such as providing for the regulation of specified security procedures including for secure electronic signatures; and (iii) facilitates the use of electronic applications by the public sector, such as allowing government agencies to accept electronic filings and documents without having to amend their respective Acts. The ETA also implements the United Nations Convention on the Use of Electronic Communications in International Contracts.
